Description and Purpose of Airbük.

Airbük is a mobile app for iOS and Android, both published by Airbük Inc. Both the mobile applications are referred to in this Terms of use as "App".

Airbük is a platform that enables and facilitates peer-to-peer delivery services involving Buyers and Flyers.

In order to use Airbük as either a Buyer or a Flyer, you must first become a Member by establishing an

Airbük account, once you are a Member, you may post offers on the App to buy and transport any item as

a Flyer to a Buyer for a mutually negotiated reward amount. This Airbük website is only for information and contact purpose.

Who is a Buyer?

Members who, post request on the app for an item to be delivered to them by the other members of the App flying into their location are known as Buyers or Buyer.

Who is a Flyer?

Members who post offers on the apps to buy and transport items to other members of the App when traveling to their destination are known as Flyers or Flyer.

What is a Reward?

The mutually agreed amount which the Buyer promises to pay the Flyer upon receiving the item from the Flyer is referred to as ‘Reward’ in the Airbük App.

How to Establish an Airbük Account ?

You can establish an account on Airbük only through one of the three mentioned social network; Facebook, Instagram or Google. You must be at least eighteen (18) or older to be a Member, you must confirm that you have read the Airbük Terms & Conditions, the Airbük Privacy Policy and you agree to be bound by them.

When establishing an Airbük account through any of the above mentioned Social Network. You agree that the information provided about yourself to Airbük is accurate, and you must keep it accurate in case it changes and you consent to Airbük having access to basic information in your social network profile whichever account you choose to login from. You also consent to Airbük using your social network account to contact you regarding your Airbük account.

Managing Your Airbük Account

You are responsible for all actions taken in the name of your account. If you know or suspect that your account has been hacked, notify Airbük immediately at support@airbuk.com so that Airbük can shut down your account.

The Transaction between a Flyer and a Buyer

In order to facilitate the process of a Flyer and a Buyer coming to agreement on a transaction, Airbük has posted Buyer’s Terms and Flyer’s terms.

Fees for Delivery Services

Airbük does not set fees for delivery services. Fees are negotiated by the parties to a transaction.

Buyer’s Payment Terms

After a Buyer has completed an order and entered credit card and other necessary information and clicked pay after reviewing the summary order screen, Airbük will then charge that amount to the Buyer’s credit card to perform the transaction at the terms specified by Buyer and Flyer. Airbük will only deduct 10% of the total transaction or $2 whichever is ‘Higher’ as the app commission, which also includes Stripe's fee.

Flyer’s Reimbursement Terms

After Airbük receives confirmation from the Buyer that the item has been received in good condition. The Flyer will be reimbursed the amount owed to the Flyer for the transaction in cash by the Buyer.

Taking Delivery of an Item

Airbük strongly recommends that all in-person meetings between a Flyer and a Buyer take place in a public location.

Risk of Loss of an Item

In most jurisdictions, a Flyer carrying an item for a Buyer in a transaction arranged through Airbük would not be responsible for loss of the item, so long as the Flyer used ordinary care to safeguard the item. For example, if the Flyer put the item into checked baggage on a flight and the bag was lost or destroyed through no fault of the Flyer, the loss would fall upon the Buyer.

Safety Violations

In case you experience a safety concern as either a Buyer or a Flyer that you believe was caused by the other party to a transaction arranged through Airbük, please notify Airbük immediately at support@airbuk.com Airbük will investigate the incident, and may terminate the account of the Member whose conduct led to the safety concern.

Prohibited Items

It is the responsibility of the Flyer to inspect any item being transported, making a reasonable attempt to confirm that it is not a prohibited item. This inspection may require the Flyer to unwrap an item that cannot be identified without unwrapping it. The following items are prohibited:

  • Hazardous Material as defined by the U.S. Environmental Protection Agency (EPA), the U.S. Occupational Safety and Health Administration (OSHA), the U.S. Department of Transportation (DOT), or the U.S. Nuclear Regulatory Commission (NRC).

  • Counterfeit goods or currency

  • Stolen property

  • Alcohol

  • Live Animals

  • Firearms, ammunition, explosives

  • Human remains

  • Pornography

  • Illegal Drugs

  • Any product or item related to illegal activities, such as the production of illegal drugs

  • Any item that is prohibited by law in the place of origin, the destination, or any jurisdiction through which the item will be transported

  • Batteries

  • Aerosols and flammable liquids

  • Knives, police batons, and other weapons

  • Items imported into the U.S. without a customs declaration, if one was required.

  • Transportation by Air

All items transported by air (whether carried onboard by the Flyer or transported in checked baggage) must comply with TSA Rules.

Use of the Airbük App by you.

We grant you a license to use the Airbük App for the limited purpose of entering into peer-to-peer courier transactions in good faith, according to the Airbük Terms of Use, as either a Buyer or a Flyer, or both. Your license is non-exclusive. You may not assign it or sublicense it. We may terminate it on the terms stated herein. You may not copy anything on the site or make any derivative works. In case you post any content on the App, you grant us a license to copy that content and make derivative works. We may also perform, display, and distribute the copies and derivative works. Our license from you is perpetual and world-wide.

In case you attempt to hack the Airbük App or site, post material that is illegal, or introduce elements that compromise the security of the site, we may terminate your account immediately and take other steps to recover our losses caused by your misconduct.

Changes to these Terms of Use

Airbük may change these Terms of Use at any time. When that happens, Airbük will mark the Terms of Use with the date on which they were most recently updated.

Governing Law

These Terms of Use are governed by and shall be interpreted in accordance with the laws of the State of Delaware, U.S.A. as they apply to contracts made and performed entirely within the State of Delaware.

The Role of Airbük in Any Transaction

Airbük’s only role in any transaction between a Flyer and a Buyer for the delivery of goods is that of a facilitator and intermediary whose app has allowed the Flyer and Buyer to locate each other and work out the details of a delivery transaction that meets their respective needs. Airbük has no responsibility for any party’s performance of its obligations in that transaction.

Your Feedback

You may send feedback about Airbük to support@airbuk.com. You grant us a perpetual, world-wide, fully-paid license to copy, perform, and distribute that feedback, to create derivative works of the feedback, and to copy, perform, and distribute those derivative works.

Digital Millennium Copyright Act

If you believe that work residing or accessible on or through Airbük infringes a copyright, please send a notice of copyright infringement at support@airbuk.com with the following information (your "Notice"):

  • Identification of the work or material that you claim has been infringed. If this material exists online, please provide a URL.

  • Identification of the material that is claimed to be infringing, including its location on Airbük, with sufficient detail so that Airbük is capable of finding the material and verifying its existence (e.g., in most circumstances, we will need a URL).

  • Contact information, including your name, address, telephone number, and email address.

  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or law.

  • A statement by you that the above information in your Notice is accurate and that, under penalty of perjury, you are the copyright owner or authorized to act on the copyright owner’s behalf.

  • A physical or electronic signature of the owner of the copyright that has been allegedly infringed or a person authorized to act on behalf of the owner.

Buyer’s Terms

Transaction Steps

Buyer sets the price of the item plus applicable taxes, customs duties, etc. (manually, based on his knowledge).

Buyer affirms that the item is not cash or anything that cannot be imported lawfully into the destination country.

Buyer Sees the Airbük commission of 10% or minimum $2 based on that cost (inclusive of PayPal fees).

Buyer sets the reward for the Flyer (manually).

Buyer agrees that when Airbük receives proper documentation of any duties, VAT, or other similar charges paid by Flyer not already accounted for in the price set by Buyer, Airbük may charge Buyer’s credit card for that amount, and remit the proceeds to Flyer.

Buyer sees total for the proposed transaction (other than duties, VAT, etc.).

Buyer enters his credit card, name and other necessary information

Buyer sees order summary screen and clicks pay.

Airbük Inc. charges that amount to the Buyer’s credit card when a Flyer willing to perform the transaction at the terms specified by Buyer has been located and is matched up with the Buyer.

Ownership and Risk of Loss

Until an item has been delivered to the Buyer, Flyer retains ownership of it. This will typically be consistent with a purchase receipt obtained by the Flyer when procuring the item for delivery to the Buyer. Flyer shall exercise ordinary care in safeguarding the item. However, all risk of loss to the item will be on Buyer, not Flyer, during transit, unless the loss is caused by Flyer’s negligence.

Import Restrictions and Charges

Before you place your order, please make sure you have acknowledged any import duties that could be associated with this order. If Flyer will be charged, you will be responsible to compensate Flyer either upon delivery or in advance. We recommend you avoid cash transactions by adding the import duties to the amount of the reward.

Dispute Resolution

Upon request by Buyer or Flyer, Airbük will assist in dispute resolution between the parties. Both parties agree to participate reasonably in such dispute resolution process, which will typically be performed via e-mail or phone. In order to request dispute resolution by Airbük, send an e-mail to support@airbuk.com.

Airbük’s Limited Roles; No Liability

Airbük’s only roles in the transaction between Buyer and Flyer are: (a) to connect Buyer with Flyer, to enable Buyer and Flyer to voluntarily enter into the transaction on terms of their own choosing; and (b) to provide limited dispute resolution services. Airbük shall not be responsible for any customs or import problems that may arise from the transaction, or for any loss, injury, or damage that either Buyer or Flyer may experience in connection with or arising out of the transaction.

Transaction Steps

Flyer sees the proposed reward for the transaction and other details of the transaction.

Flyer agrees to pay any duties, VAT or other similar charges that may be owing for importing the item, subject to being reimbursed by Buyer.

Flyer will be reimbursed the amount owing to Flyer for the transaction in cash by Buyer after Airbük receives confirmation from the Buyer that the item has been received in good condition.
